| 内容記述 | 本稿では、戦後我が国における親の教育権論の展開を歴史的に概観していく。具体的には、まず、1947年に発布・施行された（旧）教育基本法において親の教育権がどのように位置付けられていたかを捉えた上で、同法作成に深く関与した田中耕太郎による先駆的な親の教育権論を概観する。 次に、1950年代以降の「国民の教育権論」と「国家の教育権論」の対立図式下で親の教育権がどのように解釈されたのかを、両立場の代表的論者の見解の分析から捉えていく。その上で、1980年代の管理教育批判の中で、国民の教育権論を批判する文脈で親の教育権を積極的に擁護した今橋盛勝以降の議論展開を整理する。そして最後に、2000年代以降の親の教育権論を、筆者の関心とする親の教育権限行使の適正化という観点から、簡単にまとめることとしたい。 |

| 内容記述 | This paper analyzes the theoretical transition of the parental rights to education in post-war Japan. In concrete terms, at first I survey how the parental rights to education was placed in the Fundamental Law of Education of 1947, and consider the path-breaking argument of Kotaro Tanaka who participated in this law making deeply. Secondly, I clarify the discourses on the parental rights from the 1950s to the 1970s by means of analyzing controversy over the rights to education of those days; the theory of the people's rights to education vs the theory of the national rights to education. Then, I give an overview of the deployment of the arguments about the parental rights to education after Morikatsu Imahashi protected these parental rights positively in context to criticize the theory of the people's rights to education in the 1980s, and attempt to sort out the future points for discussion. |
