| 内容記述 | 1980年にアメリカの倫理学者H､ラフオレットが提唱した「親のライセンス化」論は、児童虐待の事前規制、ひいては親の教育権限行使の適正化を巡る最もラディカルな理論の一つとして、同国で賛否両論の議論を呼び起こすこととなった。ただしラフォレット自身は、この「親のライセンス化」をあくまで理論的に提唱するにとどまっており、その具体的な制度構想は、特に1990年代に入って、児童精神医学者J.ウエストマンによって為されることとなる。そこで本稿では､ラフォレット以降の｢親のライセンス化」論の展開として、このウェストマンの所論の検討を試みることとする。具体的には、ウェストマンの1994年の著書『親のライセンス化』（Licensing Parents）について、そこでの鍵概念としてのペアレンティング（parenting）概念を整理した後、彼の構想した親ライセンス制度を、①ライセンス取得の基準、②ライセンス手続きの管理、③ライセンスの否定､④親の適性試験という４つの観点から概観し､その特徴と問題点を明らかにしていく。その上で、最後にこのウェストマン以降の議論の展開について簡潔にまとめ、今後の検討課題を整理することにしたい。 | |||||

| 内容記述 | The theory of licensing parents that American ethicist Hugh LaFollette proposed in 1980 have occurred the debate as to the pros and cons in the United States, as one of the most radical argument over prior regulation of the child abuse and parental authority. But LaFollette simply proposes this opinion theoretically, and the concrete system design was done by American child psychiatrist Jack C. Westman in the 1990s. Therefore, in this paper, I put this Westman' s argument as a development of the theory of licensing parents after LaFollette, and examine the meanings and problems of it. Specifically, 1 pick up his Licensing Parents: Can We Prevent Child Abuse and Neglect? in 1994, (i) analyze how he use the word "parenting" as one of the key concept of this book, (ii) survey his design on parental licensure system from four viewpoints ; (a) criteria for licensure, (b) the administration of licensing, (c) the denial of licensure, (d) the parent-competence testing. Furthermore, in the last of this paper, (iii) I overview the developments of this theory in 2000s, and point out subjects in the future studies. |
