| 内容記述 | In 2016, the Japanese government revised the Child Welfare Act. In enforcing this revised law, the document titled “Vision of a New Social Upbringing” was created to reflect its key principles. This paper has organized and examined three roblems with the revised law and the new vision from the perspective of the inherent rights of children. Specifically, the author discusses: (a) problems with Article 3, paragraph 2; (b) issues with the name of the new vision; and (c) challenges connected to the “right to express opinions.” Especially, though the new vision positions the right to express opinions as one of the inherent rights of children and mentions “advocacy” as a specific means to secure the contents of the rights, it doesn’t specify the details. It might be seen as that there may be a particularity of advocacy in the background. | |||||||||||||
